Which El Paso JP Court Hears Your Case
El Paso County has seven JP precincts and eight courts, because Precinct 6 has two places.
For an eviction, file with the JP court covering the rental property, not your office or the resident's forwarding address. The county publishes an official JP precinct map, and all eight courts accept filings through eFileTexas.

For money owed after the resident has left, check venue separately rather than filing automatically where the apartment was, especially if the former resident has left El Paso County.
Filing an Eviction or a Money Claim
El Paso County has its own eviction petition, and the case type for a post-move-out balance depends on who's suing.
The county's eviction petition asks for the premises address, service addresses, the grounds, notice-to-vacate details, and whether you're joining a claim for unpaid rent. It allows personal or alternative service but doesn't treat an address in Mexico as an ordinary local service address. Filed through eFileTexas, you get a file-stamped copy back electronically.
For money owed after possession is returned, pick the right case type:
- Small claims is for the owner or its authorized representative suing on its own claim for rent, utilities or damage.
- Debt claim is for an assignee, debt buyer, collection agency or lender. Rent being a "debt" doesn't make it a debt-claim case.
- Either way, the JP court's limit is $20,000, excluding statutory interest and court costs.
Bring the lease, ledger, notices, move-out statement, photos and invoices for damages, every Texas service address you have, and an SCRA military-status declaration.
Current Filing, Service and Writ Costs
El Paso County raised its sheriff and constable fees effective January 1, 2025, and several precinct pages still show the old figures.

These come from the Precinct 1 fee schedule and the Commissioners Court's 2025 sheriff and constable fee order. Watch for conflicts: Precinct 7 still quotes $139 for a one-defendant claim using an older $85 service fee, an older packet shows $220 to execute a writ, and Precinct 1 labels a writ of re-entry $225 while its own breakdown adds to $255. Get a clerk quote before you pay.
How Long It Takes
The eviction track is fast and predictable. Collecting money after move-out isn't.

A clean, successfully served eviction is roughly a two-to-four-week process; Fort Bliss's own tenant eviction guide describes the same JP sequence and five-day appeal window. Money suits and post-judgment collection take much longer, because finding and serving the former resident, waiting out the answer period and locating assets all add time.
Rental Assistance Programs
El Paso has no eviction moratorium or mandatory diversion docket, but several programs pay landlords directly.
- County General Assistance offers emergency rent help to eligible county residents, including inside city limits. The landlord supplies an owner statement, W-9 and lease, and the application doesn't stop the case.
- Veterans Assistance Heroes Project can pay short-term rent for qualifying active-duty members, veterans and families, with checks sent to the landlord. The current grant cycle ran from July 1, 2025 through August 31, 2026, so check whether funding has been renewed.
- City homelessness-prevention funding flows through funded providers inside city limits and may require an inspection and a landlord agreement.
- The Texas Eviction Diversion Program closed in summer 2023. Don't treat it as an open option.
If you agree to hold a case while assistance is pending, document it through the court as a continuance or agreed judgment rather than assuming the referral pauses deadlines.
Fort Bliss and the SCRA
Military status checks aren't optional paperwork in El Paso. They're a routine part of every default.
The Texas Comptroller counted 30,288 active-duty personnel at Fort Bliss in 2025. Before any default judgment, the Servicemembers Civil Relief Act requires an affidavit stating whether the defendant is in military service. Run each defendant through the Defense Department's official SCRA status site and save the certificate; don't rely on whether the application listed military employment. If the defendant is on active duty, the court has to appoint an attorney before entering default and may stay the case at least 90 days. The Justice Department has brought enforcement actions over inaccurate military affidavits.
Early lease termination. A servicemember can end a residential lease if it was signed before entering active duty, or if they later get permanent change of station or deployment orders of at least 90 days. They give written notice with the orders. For monthly rent, termination takes effect 30 days after the next rent due date. You can collect rent accruing before that date and legitimate damage charges, but not an early-termination fee. Separate those lines on the ledger before placing the account, or the whole balance looks like a prohibited penalty.
When a Former Resident Moves to Mexico
Moving across the border doesn't cancel the debt. It does change what's worth pursuing.
If the resident wasn't served before leaving, don't mail a Texas citation to Mexico and assume it's valid. Mexico is a party to the Hague Service Convention, so international service has to follow the Convention and the court's rules, which is slow and costly. A collector can still send lawful payment communications to an address, email or phone number in Mexico, negotiate a settlement, and take electronic payments, subject to the same federal and Texas collection rules.
After judgment, Texas tools stop at the border. A recorded El Paso County abstract creates a lien on non-exempt real property in that county, not on property in Ciudad Juárez, and a Texas constable can't seize a car or bank account located in Mexico. The practical options are:
- Execute against bank accounts or non-exempt assets still in Texas.
- Record the abstract in case the debtor owns or later buys non-exempt property in El Paso County.
- Use post-judgment discovery to find Texas assets or employment.
- Negotiate a lump sum or payment plan.
- For a large enough balance, have Mexican counsel assess enforcing the Texas judgment there.
Never threaten arrest, immigration consequences or seizure in Mexico. Unpaid rent is a civil claim. For a modest balance, international litigation usually costs more than it recovers, so preserve the judgment and Texas lien rights and keep watching for Texas assets. Collecting a JP Judgment in El Paso
Two tools do most of the work: the abstract and the writ of execution.
Abstract of judgment. Request it from the JP court that issued the judgment for $5 and record it with the El Paso County Clerk for $26. Once recorded and indexed, it creates a lien on the debtor's non-exempt real property in the county, including property acquired later. A Texas judgment lien ordinarily lasts ten years. It won't attach to a homestead, and it doesn't pull money from wages or a bank account by itself.
Writ of execution. After the 30-day waiting period, request it from the JP for $5 and pay the $250 constable charge. The constable can seize and sell non-exempt property, but point them to likely assets rather than expecting an open-ended search, and know that you may lose the fee if nothing collectible turns up. Current wages are generally exempt from garnishment in Texas, though bank accounts may be reachable through a separate garnishment.
A Note on El Paso Market Data

We couldn't extract a consistent 2024 to 2026 series of El Paso multifamily rent, vacancy and eviction filings from a single named source, and mixing asking-rent sites, Census vacancy and court data from different geographies produces a misleading picture. The Texas Office of Court Administration publishes justice-court activity by county, but its summary lumps civil categories together, so it shouldn't be quoted as an eviction count.
