When a Servicemember Can End a Lease Early

The Servicemembers Civil Relief Act gives qualifying servicemembers a federal right to end a residential lease, whether or not the lease has a military clause. Under 50 U.S.C. 3955, the right applies when (50 U.S.C. 3955):

  • the tenant signed the lease and then entered military service;
  • a servicemember signed the lease and later received permanent change of station (PCS) orders, or orders to deploy for at least 90 days; or
  • a servicemember signed after receiving qualifying orders and then got a stop-movement order that keeps them or their dependents from moving in.

To use it, the servicemember delivers written notice and a copy of the orders to the landlord or its agent. Military OneSource tells servicemembers to deliver by hand, private carrier or return-receipt mail (Military OneSource). For a lease with monthly rent, termination takes effect 30 days after the first rent due date following delivery of the notice. The calculator below works out that date.

What You Can Still Collect After an SCRA Termination

An SCRA termination ends future rent. It doesn't erase the balance up to the effective date. The servicemember still owes rent through the effective termination date, prorated, and still owes legitimate charges that were due and unpaid at termination, including reasonable charges for excess wear (50 U.S.C. 3955, Cornell LII).

After a valid SCRA lease termination
ChargeCollectible?
Rent through the effective termination date, proratedYes
Damage beyond normal wear, documentedYes
Other lease charges already due and unpaidYes
Early termination or lease-break feeNo. The statute bars it.
Rent for months after the effective dateNo. Prepaid rent for that period must be refunded within 30 days.
Repayment of move-in concessions or incentivesTreat as no. DOJ has settled several cases over it.

That last row is where most property managers get caught. In 2023, the Justice Department settled with two apartment managers that required servicemembers ending leases under qualifying orders to repay concessions: one paid $41,581.95 to at least nine servicemembers plus a $20,000 civil penalty, and the other paid $51,587 to nine servicemembers plus $22,500 (DOJ, Servicemembers cases). In 2024, a property manager paid $10,225.65 and a $3,000 penalty after refusing a Navy petty officer's termination, charging early-termination fees and extra rent, and wrongly citing a 35-mile limit that the federal statute doesn't contain.

So build the balance from the effective date, not from the lease end date. Then apply the deposit within your state's deadline, as you would for any move-out (see security deposits and move-out charges).

Default Judgments, Evictions and Interest

Three more SCRA rules affect how a military tenant's balance gets collected.

The military-status affidavit. Before any default judgment, including in an eviction or a suit for rent, the plaintiff must file an affidavit stating whether the defendant is in military service, or that it can't determine status. If status can't be determined, the court generally can't enter a default until it appoints an attorney for the defendant, and a judgment entered without the required steps can be reopened (50 U.S.C. 3931). In 2026, DOJ settled with a property manager that allegedly filed a false affidavit and got a default eviction against an active-duty Navy sailor: $60,000 in compensation, 10 years of credit monitoring and a $6,000 penalty (DOJ).

Evictions. While a servicemember is on active duty, a landlord can't evict them or their dependents from a residence except by court order, as long as the rent is at or below an inflation-adjusted ceiling. For 2026 that ceiling is $10,542.60 a month (Federal Register, 2026; 50 U.S.C. 3951). The court can also stay the case if military service materially affects the ability to pay.

The 6% interest cap. For debts incurred before entering service, interest above 6% a year must be forgiven during service, and fees treated as interest count toward it (DOJ). Most rent debt isn't charged interest at all, but if your lease charges interest on balances and the lease predates service, check this before the account goes out.

State Military Lease Laws in Texas, Arizona, Utah and Oregon

Each state adds its own layer. Where state and federal law overlap, the servicemember gets whichever protection applies.

Where Military Tenants Are Concentrated

The rules matter most near the large installations. These are installation-wide headcounts, not tenant counts, but they show where SCRA terminations cluster, especially in the May to August PCS season.

A Safe Sequence Before You Place a Military Tenant's Balance

  1. Pause adverse action as soon as military status is claimed or suspected.
  2. Verify status on the Defense Manpower Data Center's SCRA site, which issues a certificate of active-duty status for a given date (DMDC SCRA). An account is required; match on SSN where you have it. Save the certificate in the file.
  3. Get the notice and orders if the tenant ended the lease early, with proof of how and when the notice was delivered.
  4. Recalculate the balance from the effective termination date: prorated rent, documented damage, no lease-break fee, no concession clawback.
  5. Apply the deposit within your state's deadline.
  6. Flag the account as military when you place it, with the certificate, notice, orders and recalculated ledger attached.
  7. Ask counsel before filing suit or reporting to credit bureaus on a large or contested balance. The installation housing and legal assistance offices can explain local processes, but they advise servicemembers, not landlords.

Collectors have their own reasons to get this right. Servicemembers, veterans and their families filed about 11,700 debt collection complaints with the CFPB in 2023, a record, and debt collection made up 13.8% of their complaints versus 6.6% for consumers overall (CFPB Office of Servicemember Affairs). More than half concerned debts the consumer said weren't owed (CFPB FDCPA report, 2025). A clean, recalculated balance is the best defense against that complaint. Our FDCPA and Regulation F guide covers the rest of the collector's duties.

How Elite Recovery Group Handles Military Accounts

Elite Recovery Group screens placed accounts for military status before contact and works military balances from the recalculated ledger, not the original lease term. If you manage near Fort Cavazos, Fort Bliss, JBSA, Luke or Hill, send the move-out statement, the termination notice and orders, and the ledger, and we'll tell you what's collectible. See also collecting unpaid rent after move-out and FDCPA-compliant collections.

Frequently Asked Questions

  • Does a lease need a military clause for the SCRA to apply?

No. The SCRA termination right is federal and applies to qualifying servicemembers whatever the lease says. A military clause can add rights, but it can't take the federal ones away.

  • Should I report a military tenant's balance to the credit bureaus?

Only after it has been recalculated from the effective termination date and validated. More than half of servicemember debt collection complaints to the CFPB say the debt isn't owed, so an unadjusted balance is likely to be disputed.

  • Can I keep the security deposit for damage when a servicemember ends a lease early?

Yes, for documented damage beyond normal wear and other charges already due, applied within your state's deposit deadline. The SCRA doesn't change normal deposit rules.

  • How do I check if a former tenant is on active duty?

Use the Defense Manpower Data Center's SCRA website at scra.dmdc.osd.mil. It requires an account and issues a certificate of status for a given date. Match on SSN if you have it and keep the certificate.

  • Does the SCRA apply to National Guard members?

It applies to Guard members on qualifying federal orders. For Governor-called state duty, it depends on state law: Oregon covers it for lease termination, Utah covers it for eviction protection, and Texas and Arizona don't clearly cover it.

  • Can a collection agency contact a deployed servicemember?

Yes, but the FDCPA and Regulation F still apply in full, and a court case against them needs the military affidavit. Many collectors pause contact while the servicemember is deployed.

  • Do SCRA protections apply to veterans?

Mostly not. The lease termination and eviction protections apply during military service. A few rights reach past it, such as the 180 days after service ends to request the 6% interest cap.

  • Can a servicemember end a lease signed after receiving orders?

Generally only in the stop-movement case: orders that later keep them or their dependents from moving in. A lease signed with PCS orders already in hand doesn't otherwise qualify on those same orders.
